TERMS & CONDITIONS

Terms & Conditions

INTRODUCTION

These Terms govern your use of tahad.shop and every purchase made through it. By browsing the store or placing an order you confirm that you have read and accepted them. We may update these Terms at any time; the version published at the moment your order is confirmed is the version that applies to that order.

ARTICLE 1 — DEFINITIONS

"Customer", "you" — any person who browses the store or places an order.

ARTICLE 3 — SCOPE AND RELATED POLICIES

The Shipping & Delivery page, the Returns & Exchanges page, the Payment Methods page, the FAQ and the Privacy Policy form an integral part of these Terms. Where a specific policy conflicts with these Terms, the specific policy prevails for the matter it governs.

ARTICLE 4 — ELIGIBILITY

You must be 18 years or older, or acting with the consent of a guardian, and legally able to enter into a contract. We may refuse or cancel any order placed in breach of this Article.

ARTICLE 5 — ACCOUNTS AND CUSTOMER INFORMATION

You may purchase as a guest or create an account. You undertake to provide accurate and current contact, delivery and payment information, and to keep it updated. You are responsible for the confidentiality of your password and for every order placed through your account.

ARTICLE 6 — PRODUCTS AND DESCRIPTIONS

Each product page states the essential characteristics of the product, including material, dimensions, capacity where relevant, and care instructions.

We make every effort to display colours accurately. Screens differ, and a slight difference between the image and the delivered product is not a defect.

Products described as handmade — including ceramics, pottery, brass, wooden and woven pieces — vary from one another in colour, grain, weight and finish. This variation is inherent to how they are produced and is not a defect.

Products containing natural materials, including agarwood, may differ in appearance and scent from one batch to another.

ARTICLE 7 — AVAILABILITY AND LIMITS ON SALE

Some products are offered in limited quantities or online only. We may limit the quantity sold to one customer, restrict sale to certain regions, or discontinue a product at any time without liability.

Limited editions are produced in the quantity stated on the product page and are not reproduced once sold out.

ARTICLE 8 — PRICES AND TAX

All prices are in Saudi Riyals and include 15% Value Added Tax. Shipping fees, where applicable, are shown separately at checkout before payment.

We may change prices at any time. A change does not affect an order that has already been confirmed.

Where a price or deion is published in clear error, we may cancel the affected order and refund any amount paid in full.

ARTICLE 9 — ORDERS AND CONTRACT FORMATION

Displaying a product is an invitation to order, not an offer. The contract is concluded when we send you an order confirmation. We may decline an order where the product is unavailable, the price or deion is clearly wrong, the delivery address is outside our service area, or the order appears fraudulent.

ARTICLE 10 — ELECTRONIC INVOICE

After the contract is concluded we issue an electronic invoice showing the price of each item, the total including tax and any delivery fees, and the delivery details.

ARTICLE 11 — PAYMENT

Accepted payment methods are listed on the Payment Methods page. Payment is processed through a certified payment gateway. Card details are entered with the gateway and are never seen or stored by us. The amount is captured when the order is confirmed.

ARTICLE 12 — FRAUD PREVENTION

We may verify payments, discount codes and customer details before dispatch, place an order on hold pending verification, refuse or cancel an order we reasonably believe to be fraudulent, suspend an account used improperly, and cooperate with the competent authorities.

ARTICLE 13 — SHIPPING AND DELIVERY

Delivery terms, fees and timing are set out on the Shipping & Delivery page. Risk in the products passes to you on delivery.

If an order has not reached you within 15 days of the agreed delivery date, you may cancel it and receive a full refund.

ARTICLE 14 — RETURNS, EXCHANGES AND CANCELLATION

You may cancel the purchase and return the product within 7 days of receiving it, provided it has not been used, in line with the Saudi E-Commerce Law.

Products made to your specifications or personalised with your name or design, and gift cards, cannot be returned. Further exclusions, conditions and timings are set out on the Returns & Exchanges page.

An order cannot be amended once it has been prepared or shipped.

ARTICLE 15 — GIFT CARDS

Gift cards are delivered electronically, are valid for the period stated on the card, cannot be exchanged for cash, and are not returnable. A lost or forwarded code is the holder's responsibility.

ARTICLE 16 — CUSTOMER REVIEWS AND SUBMISSIONS

If the store invites reviews, photographs or comments, you grant us a non-exclusive, royalty-free right to publish and use what you submit in connection with the store and its marketing, with attribution to the name you supply.

Submissions must be lawful, must not infringe the rights of others, and must not contain personal data of third parties. We may edit, decline or remove any submission without notice.

ARTICLE 17 — INTELLECTUAL PROPERTY

All designs, drawings, illustrations, photographs, text, logos and trade marks on tahad.shop are owned by Tahad or licensed to it and are protected under the laws of the Kingdom of Saudi Arabia.

Nothing on this site may be copied, reproduced, printed on any product, or used commercially without our prior written consent.

Purchasing a product transfers ownership of that physical item only. It does not transfer any right in the design printed, woven or engraved on it.

ARTICLE 18 — PROHIBITED USE

You may not use the store for any unlawful purpose; interfere with its operation, security or source code; extract its content by automated means including scraping; upload malicious files; impersonate another person; collect data about other users; or resell products purchased here as a commercial reseller without a separate written agreement. We may suspend access immediately for any breach of this Article.

ARTICLE 19 — THIRD-PARTY LINKS AND TOOLS

The store may link to, or operate through, third-party services such as payment gateways, shipping companies and analytics tools. These are provided as they are. We are not responsible for the content, policies or performance of any third party, and your dealings with them are governed by their own terms.

ARTICLE 20 — LIMITATION OF LIABILITY

We are responsible for delivering products that match their deion and are free from manufacturing defects. We are not liable for damage arising from misuse, neglect, or failure to follow the care instructions supplied with the product, nor for indirect or consequential loss. Nothing in these Terms limits any right granted to you under the laws of the Kingdom.

ARTICLE 21 — INDEMNITY

You agree to indemnify us against any claim, loss or reasonable legal cost arising from your breach of these Terms or your unlawful use of the store.

ARTICLE 22 — FORCE MAJEURE

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including natural events, official decisions, and disruption of shipping, payment or communication networks.

ARTICLE 23 — SUSPENSION AND TERMINATION

Either party may end this agreement at any time. We may suspend or close an account that breaches these Terms, without affecting any order already confirmed and paid for.

ARTICLE 24 — SEVERABILITY

If any provision of these Terms is found invalid or unenforceable, that provision is severed and the remaining provisions continue in full effect.

ARTICLE 25 — ENTIRE AGREEMENT AND WAIVER

These Terms, together with the policies referred to in Article 3, form the entire agreement between us. Our failure to enforce any right does not amount to a waiver of it. Any ambiguity is not to be construed against the drafting party.

ARTICLE 26 — PRIVACY

Personal data is handled as described in our Privacy Policy, which forms part of these Terms.

ARTICLE 27 — AMENDMENTS

We may amend these Terms. Continued use of the store after an amendment is published constitutes acceptance of the amended version.

ARTICLE 28 — GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the Kingdom of Saudi Arabia, including the E-Commerce Law and its Implementing Regulation. Any dispute falls within the jurisdiction of the competent Saudi judicial authorities. A complaint may also be filed with the Ministry of Commerce through its official channels.

ARTICLE 29 — CONTACT
